Terms of Service

Welcome to DriveSchoolHub. By accessing or using our website, mobile applications, or any other services we provide (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using DriveSchoolHub's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

We may modify these Terms at any time. We will notify users of material changes by posting a notice on our website or sending an email. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

2. Description of Services

DriveSchoolHub is a marketplace platform that connects students and families seeking driving education with state-approved driving schools and instructors. Our Services include:

  • A searchable directory of driving schools across the United States
  • Online booking and scheduling tools for driving lessons
  • Secure payment processing for lesson fees
  • Review and rating systems for schools and instructors
  • Educational resources including practice tests and guides
  • Tools for driving schools to manage their business

DriveSchoolHub does not itself provide driving instruction. We are an intermediary platform connecting students with independent driving schools.

3. User Accounts

3.1 Account Registration

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

DriveSchoolHub offers different account types for students, driving schools, and administrators, each with specific features and responsibilities.

4. Booking and Payments

4.1 Booking Process

When you book a lesson through DriveSchoolHub, you are entering into a contract directly with the driving school. DriveSchoolHub facilitates this transaction but is not a party to the contract between you and the school.

4.2 Payment Terms

All payments are processed securely through our payment processor, Stripe. By making a payment, you authorize us to charge the payment method provided. Prices displayed include applicable taxes unless otherwise stated.

4.3 Cancellation and Refunds

Cancellation and refund policies are set by individual driving schools and will be displayed at the time of booking. DriveSchoolHub may facilitate refund requests but the final decision rests with the driving school according to their stated policies.

5. For Driving Schools

5.1 School Registration

Driving schools must provide accurate information about their business, including licensing and insurance details where required by law. Schools are responsible for maintaining all necessary permits and certifications.

5.2 Service Standards

Schools agree to provide services as described in their listings, maintain professional standards, and comply with all applicable laws and regulations governing driver education.

5.3 Fees and Payouts

DriveSchoolHub charges a service fee for bookings made through our platform. The current fee structure is detailed on our Pricing page. Payouts to schools are processed on a regular schedule as specified in our school dashboard.

6. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws
  • Post false, misleading, or fraudulent content
  • Harass, abuse, or harm other users or driving schools
  • Interfere with the proper functioning of the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use automated tools to access or interact with the Services without permission
  • Submit fake reviews or manipulate ratings
  • Circumvent or attempt to circumvent any payment obligations

7. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of DriveSchoolHub or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our Services without our prior written consent.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DriveSchoolHub does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the Services.

We do not endorse, guarantee, or assume responsibility for the quality, safety, or legality of any driving school or instructor listed on our platform.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVESCHOOLHUB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS PAID BY YOU TO DRIVESCHOOLHUB IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless DriveSchoolHub and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Services.

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal legal claim, you agree to contact us and attempt to resolve any dispute informally. We will try to resolve your concerns within 30 days of receiving notice.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

11.3 Jurisdiction

Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas.

12. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DriveSchoolHub regarding the Services.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
