1. Introduction
Welcome to DriveSchoolHub ("DriveSchoolHub", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of:
- our website, mobile applications, and any other online services that link to these Terms (collectively, the "Platform"); and
- the services available through the Platform, including searching for, listing, booking, and managing driving lessons (the "Services").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
You may use the Platform only in compliance with these Terms and all applicable laws.
2. Marketplace nature of the Platform
DriveSchoolHub is an online marketplace and booking platform that connects individuals or entities offering driving instruction ("Schools", which includes their instructors and staff) with individuals seeking such instruction ("Students").
- DriveSchoolHub does not own, operate, or control the driving schools, vehicles, or instruction listed on the Platform.
- Lessons are provided solely by Schools as independent businesses.
DriveSchoolHub is not a party to any agreement between a Student and a School other than as expressly set out in these Terms (for example, as payment facilitator).
Nothing in these Terms creates a partnership, joint venture, or employment relationship between DriveSchoolHub and any School or instructor.
3. Eligibility and accounts
To use most features, you may need to create an account. You must:
- provide accurate and complete information;
- keep your information current; and
- keep your login credentials secure.
By creating an account or using the Platform, you represent and warrant that:
- you are at least the age of majority in your jurisdiction, or you have consent from a parent or legal guardian;
- you have the right, authority, and capacity to agree to these Terms; and
- you are using the Platform for lawful purposes only.
You are responsible for all activity that occurs under your account. You must notify us immediately if you believe your account has been compromised.
We may suspend or terminate your account at any time if we believe you have violated these Terms or pose a risk to the Platform or other users.
4. School and instructor obligations
If you register as a School or instructor:
Licensing and compliance
- You are solely responsible for obtaining and maintaining all licenses, permits, authorizations, and insurance required to provide driving instruction in each jurisdiction where you operate.
- You must comply with all applicable laws, regulations, and rules, including but not limited to driver education standards, traffic laws, and child-protection requirements.
Accuracy of information
- You must provide accurate information about your business, instructors, vehicles, prices, availability, and policies and update this information promptly when it changes.
- You must clearly disclose your cancellation and refund policy and agree that Students may rely on that policy when booking.
Quality and safety
- You are solely responsible for the safety, condition, and legality of any vehicles used for instruction.
- You are responsible for the conduct of your instructors and staff.
- You must treat Students respectfully and professionally at all times.
Verification
You agree that DriveSchoolHub may request documentation or conduct checks (for example, license numbers, insurance certificates) and may suspend or remove your listings if verification cannot be completed to our satisfaction.
5. Student obligations
If you use the Platform as a Student:
- You are responsible for carefully reviewing the School's description, pricing, and refund/cancellation policy before booking.
- You are responsible for ensuring that you meet any prerequisites for the lesson (for example, having a valid learner's permit).
- You agree to arrive on time, follow safety instructions, and comply with all applicable laws while participating in lessons.
- You must treat Schools, instructors, and other students respectfully and may not engage in harassment, abuse, or illegal behavior.
6. Bookings, payments, and refunds
Payments
- When you book through the Platform, you authorize DriveSchoolHub to charge your selected payment method for the full amount shown at checkout.
- DriveSchoolHub or its payment processor receives payment as a limited payment collection agent for the School.
Escrow
Funds may be held in escrow until lessons are completed or cancelled, as further described in our Payments, Escrow & Refunds policy.
Refunds and cancellations
- Each School sets its own cancellation and refund policy, which is presented at checkout. That policy supersedes any default platform policy, except where prohibited by law.
- Refunds, if any, are processed according to the School's policy. DriveSchoolHub may enforce minimum standards or issue refunds in certain cases (for example, fraud or safety issues), at our discretion.
Price changes
Schools may adjust their prices at any time, but changes do not affect bookings already confirmed.
Chargebacks
If you initiate a chargeback, you agree to cooperate with our investigation. We reserve the right to suspend or terminate your account in cases of fraudulent or abusive chargebacks.
7. Reviews and user content
The Platform may allow you to post reviews, ratings, messages, photos, or other content ("User Content").
- You retain ownership of your User Content, but you grant DriveSchoolHub a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate, and display such content in connection with operating and promoting the Platform.
- You are solely responsible for your User Content and represent that you have all necessary rights to post it and that it does not violate any law or third-party rights.
- You may not post content that is illegal, defamatory, obscene, hateful, discriminatory, or otherwise objectionable, as determined by us in our sole discretion.
- We may remove or modify User Content at any time for any reason.
8. Prohibited activities
You agree not to:
- use the Platform for any unlawful purpose;
- violate any applicable laws or regulations;
- misrepresent your identity or affiliation;
- attempt to circumvent the Platform's payment systems;
- access, scrape, or use the Platform through any automated means without our written permission;
- interfere with the operation of the Platform or attempt to gain unauthorized access to any systems;
- encourage or enable others to violate these Terms.
We may investigate and take appropriate action (including legal action) against anyone who, in our judgment, violates these Terms or otherwise abuses the Platform.
9. Intellectual property
The Platform, including all content, design, text, graphics, logos, icons, interfaces, code, and software, is owned by or licensed to DriveSchoolHub and is protected by intellectual-property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal or internal business use, subject to these Terms.
You may not:
- copy, modify, distribute, sell, lease, or create derivative works based on the Platform;
- reverse engineer or attempt to extract the source code of any software, except as permitted by law;
- remove or alter any copyright, trademark, or other proprietary notices.
"DriveSchoolHub" and associated logos are trademarks or service marks of DriveSchoolHub or its affiliates. You may not use them without our prior written consent.
10. Third-party links and services
The Platform may contain links to third-party websites or services that are not owned or controlled by DriveSchoolHub. We do not endorse or assume responsibility for any third-party sites, content, products, or services.
Your use of third-party sites is at your own risk and subject to their terms and policies.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Platform and Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, we do not warrant that:
- the Platform will be uninterrupted, secure, or error-free;
- any content will be accurate, complete, or up to date; or
- any particular result (such as passing a driving test) will be achieved.
All use of the Platform is at your own risk.
12. Limitation of liability
To the maximum extent permitted by law:
- DriveSchoolHub and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, or replacement costs, arising out of or related to your use of the Platform or any lessons, even if we have been advised of the possibility of such damages.
- DriveSchoolHub's total aggregate liability to you for all claims arising out of or related to the Platform or these Terms will not exceed: the total amount of fees you paid to DriveSchoolHub in the six (6) months preceding the event giving rise to the claim, or one hundred U.S. dollars (US$100), whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless DriveSchoolHub and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to:
- your use of or access to the Platform;
- your violation of these Terms;
- your violation of any law or the rights of any third party; or
- any dispute between you and a School, instructor, or other user.
14. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles.
Informal resolution. Before starting any formal dispute proceedings, you agree to contact us at legal@driveschoolhub.com and attempt to resolve the dispute informally.
Arbitration / courts. Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration or the courts of Texas, as applicable under law.
Nothing in this section limits any right you may have under applicable consumer-protection laws.
15. Changes to these Terms
We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date and may provide additional notice (such as email or in-app notifications).
By continuing to use the Platform after changes become effective, you agree to be bound by the updated Terms. If you do not agree, you must stop using the Platform.
16. Termination
You may stop using the Platform at any time. We may suspend or terminate your access to the Platform at any time, for any reason, including if we believe you have violated these Terms or pose a risk to other users.
Upon termination, your right to use the Platform will cease immediately, but the following sections will survive: 7–15 and any other provisions that by their nature should survive termination.
